They then would start their own organization, which would give them an unfettered recruiting "advantage".

The private schools would soon discover they could not survive without the OHSAA public schools. For football there are less than 7 privates schools in D1. The total number of private schools would not support 7 divisions, which means much smaller schools playing much larger schools for playoffs. If Roger Bacon does not like playing with the bigger schools now, I doubt they would like to see St X, Moeller,St Ed and St Iggy every season.

If they did, I wonder if OHSAA would give a public school computer points for playing them or would they treat it as they do now with an out of state school? Could OHSAA even possibly not sanction a game between the two which would probably mean no games between them at all? Think of the increased travel the privates would incur trying to play full schedules of other privates. They want OHSAA to drop CB but they will never go out on their own, thus the lawsuit. Whoever loses the suit will just have to suck it up.
